Terms of Service

By using our services, you agree to be bound by these terms and conditions and all applicable laws and regulations. If you do not agree to any of these terms, you are prohibited from using our services. We reserve the right to amend these terms at any time, and amendments will be posted on this page. Your continued use of the services after the posting of amendments constitutes your acceptance of the modified terms.

To access most features of Rasayily, you must create an account. You are responsible for maintaining the confidentiality of your account information and password, and for all activities that occur under your account. All information you provide during registration must be accurate, complete, and up-to-date. It is strictly prohibited to use another person's account without permission.

You must use our services in a lawful and responsible manner, and in compliance with these terms and all applicable laws and regulations. Misuse of the service in any way is strictly prohibited, including but not limited to:

• Anti-Spam Policy: It is strictly prohibited to use the Rasayily platform to send unsolicited messages (Spam). The user must obtain prior and explicit consent from recipients before sending. Any violation of this policy will result in immediate account termination without refund of any paid amounts.
• Compliance with Meta Policies: The user acknowledges full commitment to WhatsApp Business Messaging Policy and WhatsApp Commerce Policy. Any use of the service that violates these policies will result in immediate account termination without refund.
• Sending any unlawful, harmful, threatening, abusive, defamatory, obscene, or hateful content.
• Impersonating any other entity or individual.
• Interfering with or disrupting the service or servers or networks connected to the service.
• Attempting unauthorized access to any part of the service or other systems or networks.

All content and materials available on the Rasayily platform, including texts, graphics, logos, icons, images, and videos, are the property of Rasayily or licensed to it, and are protected by copyright, trademark, and other intellectual property laws. You may not use any of this content without our prior written consent.

Our services are provided on a pre-paid or periodic subscription basis. All our payment processing is conducted through an approved third-party payment processor, which acts as the Merchant of Record for all our orders. The payment processor is responsible for handling payments, taxes, and managing refund requests. You agree to pay all applicable fees on time. All prices quoted do not include applicable taxes, which will be added at checkout.

All refunds are subject to our Refund Policy. You can cancel your subscription at any time through your control panel. Upon cancellation, your account will remain active until the end of the current paid period and will not be automatically renewed. No refunds will be issued for unused periods, except in accordance with the Refund Policy.

To the maximum extent permitted by law, Rasayily shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the service; (b) any conduct or content of any third party on the service; (c) any content obtained from the service; and (d) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage. Rasayily is not responsible for WhatsApp number blocking resulting from customer misuse of Meta policies or sending unsolicited messages.

Rasayily services are provided on an "as is" and "as available" basis, without any warranties of any kind, whether express or implied, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. Rasayily does not warrant that the service will be uninterrupted, secure, or error-free; or that any defects will be corrected; or that the service or the servers that make it available are free of viruses or other harmful components.

You agree to indemnify, defend, and hold harmless Rasayily from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from (a) your use of and access to the service; (b) your breach of any term of these terms; (c) your breach of any third-party right, including without limitation any intellectual property or privacy right; or (d) any claim that your content caused damage to a third party. This defense and indemnification obligation will survive these terms and your use of the service.

We reserve the right to terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation, your breach of these terms. Upon termination, your right to use the service will immediately cease. If you wish to terminate your account, you may simply discontinue using the service or contact us to request account deletion.

These terms shall be governed and construed in accordance with the laws of the Kingdom of Saudi Arabia, without regard to its conflict of law provisions. You agree to the exclusive jurisdiction of the courts in the Kingdom of Saudi Arabia for the resolution of any disputes arising from or related to these terms.

These terms constitute the entire agreement between you and Rasayily regarding our services, and supersede any prior agreements. If any provision of these terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will be interpreted in a manner that best reflects the original intent of the parties, and the other provisions will remain in full force and effect. Failure by Rasayily to enforce any right or provision of these terms will not be considered a waiver of those rights or provisions.
